Digital Millennium Copyright Act (DMCA) & EU Copyright Policy
Codex Zero VTT complies strictly with the Digital Millennium Copyright Act (17 U.S.C. § 512) and, within the European Union, with the Directive (EU) 2019/790 on copyright in the Digital Single Market, respecting the intellectual property rights of authors and publishers. As an online provider of virtual gaming spaces, we host user-generated content and documents in private campaigns. Under the DMCA Safe Harbor provisions (17 U.S.C. § 512(c)) and the EU implementation, we will respond expeditiously to remove or disable access to materials claimed to be infringing upon formal notification.
1. Filing a DMCA Takedown Notice
If you are a copyright owner or an authorized representative thereof and believe that any material or document (such as a roleplaying book PDF, token illustration, or character portrait) hosted on Codex Zero infringes upon your copyright, you may submit a formal written notice to our Designated Copyright Agent via email at: santismb@gmail.com.
To be legally effective under 17 U.S.C. § 512(c)(3), your notice must include the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Codex Zero to locate the material (such as the specific VTT campaign ID, manual filename, or chat log timestamp).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Counter-Notification Procedure
If a user's uploaded material has been removed due to a DMCA notice, the user has the right under 17 U.S.C. § 512(g)(2) to file a formal counter-notification to our Designated Agent at santismb@gmail.com. It must contain:
- The user's physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- The user's name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the user's address is outside the United States, for any judicial district in which Codex Zero may be found, and that the user will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Codex Zero maintains a strict policy to terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers of intellectual property rights.
